Commissioner submission: Review of the Workplace Gender Equality Act 2012

In 2021, the Australian Government reviewed the federal Workplace Gender Equality Act 2021 (WGE Act). The Review considered if the Workplace Gender Equality Agency (WGEA) had powers and tools it needed to improve gender equality in Australia. It also looked at any changes needed for WGEA to implement the Respect@Work recommendations.

The Commissioner made a submission to the Review. The Commissioner made 9 recommendations to improve the WGE Act and WGEA's powers. Recommendations included:

  • expanding the reporting requirements for employers, including to submit gender equality action plans
  • placing a positive duty on employers to promote and improve gender equality
  • expanding the Act to include Commonwealth public sector employers
  • including gendered segregation as a gender equality indicator in the WGE Act
  • collecting further diversity and inclusion data
  • making gender pay gap data publicly available at the organisational level
  • expanding the minimum standards to all employers covered by the WGE Act
  • strengthening WGEA's compliance and enforcement powers.
