Guidance material on the Commissioner's dispute resolution function is now live.

Under the Gender Equality Act, the Commissioner has the power to help organisations resolve systemic gender equality disputes – for example, practices or policies that disproportionately promote people of a certain gender to specific roles, or pay inequality based on gender.

The dispute resolution service is available to certain public sector organisations (as set out in the Act) that have a gender equality clause in their enterprise agreement or workplace determination that expressly provides for the Commissioner’s involvement.

The purpose of this function is to support systemic change in organisations. It complements existing equal opportunity laws such as the Sex Discrimination Act 1984 and the Equal Opportunity Act 2010.

Check out our dispute resolution page to read the Guidance Note and further information on how this function will operate.
